1/ PURPOSE AND SCOPE OF APPLICATION
These general conditions apply to contractual relations between SOMANO SAS, a company with a capital of €13,334, whose registered office is located in Le Boyer 97115 Sainte Rose, registered in the Pointe à Pitre trade register under number 813 818 077 00014, hereinafter referred to as Guadeloupe Shuttle, and the passenger who purchases a Guadeloupe Shuttle transport ticket, hereinafter referred to as the “Customer”.
Guadeloupe Shuttle is a passenger transport company and, as such, is authorized to carry out its activities through a license for the transport of passengers by road, bearing the number 2015.01.0000141 issued by the D.E.A.L. office of the Ministry of Transport of France
Guadeloupe Shuttle may have to subcontract the performance of transport services to carriers to meet demand.
Guadeloupe Shuttle offers a public transport service for people for a fee in vehicles with 5 to 9 seats (including driver) in Guadeloupe (Airport, Maritime Station, Tourist places, etc…). The Service consists in providing Customers with a collective or private vehicle with driver.
Guadeloupe Shuttle may have to subcontract to carriers to provide transport services for larger groups of people.
The Company is therefore registered in the Register of Public Road Transport Companies.
The purpose of these General Terms and Conditions is to define the conditions for booking and performing the Service, as well as the conditions for using the website www.guadeloupe-shuttle.com . They are available on www.guadeloupe-shuttle.com, as well as on simple written request to the Company’s registered office.
The Company reserves the right to modify the terms of the General Terms and Conditions (hereinafter referred to as the Contract), in whole or in part, at any time and without notice. The applicable provisions will be those in force on the day of confirmation of the reservation.
The Client must read these conditions before booking.
2/ ORDER PROCEDURES
2.1 Order Procedure
To book the transfer and/or service, the Customer can order on the website www.guadeloupe-shuttle.com or contact by phone. Reservations are subject to availability.
– Through the website:
The Customer can order at least 48 hours before the scheduled time by providing all relevant information. (Date, time, number of passengers, place of departure and arrival)
By telephone:
The Customer can book by phone at least 24 hours before departure, subject to the availability of our vehicles.
The Company’s telephone number is a non-overtaxed number.
Bookings less than 48 hours before the scheduled time of the Transfer can only be made by telephone.
In the exceptional case that the Customer is not able to receive written confirmation before the scheduled time of the Transfer, the Customer will be verbally informed of his Order number and all the information relating to his reservation.
Guadeloupe Shuttle indicates the price of the order and a proposed pick-up time as an indication and according to traffic conditions in particular.
The Client is free to accept or refuse the Company’s offer.
If he accepts it, he must have previously ensured the accuracy of the information provided by the Company on the reservation proposal. Guadeloupe Shuttle cannot be held responsible in the event of an error in this information.
Validated orders are confirmed by email or, failing that, by SMS specifying the order number.
The Customer must provide himself with his order confirmation in order to present it to the driver at the time of completion. The order number given to the Client in the case of a reservation by telephone is sufficient.
In the absence of presentation of an order confirmation or an order number, the handling will not be possible and the reservation will be considered as cancelled at the Customer’s initiative.
In the event that the Customer does not show up at the scheduled time, the driver is free to continue with his journey sheet.
2.2 Order Modifications
Changes to the Order can be made by email at least 72 hours before departure or by telephone until 24 hours before departure, specifying the order number. Modifications are made free of charge within the limits of availability for an equivalent order, journey and number of passengers in particular.
If the proposals put forward by Guadeloupe Shuttle are refused by the Client, the Client shall be free to renounce his initial order and proceed to its cancellation.
Guadeloupe Shuttle cannot be held responsible in the event of a time change of an air or sea carrier
Guadeloupe Shuttle will however do its utmost to readjust its organisation according to the new scheduled schedules. If necessary and after a waiting time of one hour compared to the initial scheduled time, the Customer will be informed of the cancellation of the transfer and will have to find an alternative means at his expense. The transfer provided for by Guadeloupe Shuttle will be due and not refunded.
2.3 Order Cancellation
At the Client’s initiative
Cancellations of Orders can only be made by email, expressly mentioning the Order number indicated on the confirmation.
The conditions for reimbursement are as follows:
– More than 15 days before departure: full refund LESS 12€ for booking fees;
– From 8 to 14 days before departure: 50% refund LESS 12€ booking fee;
– 7 days before departure: non-refundable;
The Customer is required to comply with the procedures defined in the terms of the order and execution. If a procedure is not respected by the Client on its own initiative, and had the effect of preventing the transfer, their amount would be fully due. In particular, in the event of the Client not showing up at the time and place specified in the booking confirmation for the transfer, without prior notice to the Company, no refund may be granted.
At the Company’s initiative
If the Company has to cancel a reserved Service, the Customer will be notified as soon as possible and will receive a written confirmation by email, telephone or SMS. The Company will then reimburse the amount of the sums paid for the Service.
3/ FINANCIAL CONDITIONS
The prices charged by the Company are fixed in advance and take into account the distance to be covered, the expected duration of the trip, the time of day, the date, the number of passengers and the options chosen.
The prices mentioned on the website are inclusive of VAT and include VAT at the current rate.
These prices are subject to change at any time, however the Company guarantees the application of the price list in force at the time of the order. At no time may the sums paid be considered as a deposit or instalments.
The Customer determines the payment method when ordering: by VISA, MASTERCARD, AMERICAN EXPRESS credit card or through the PAYPAL system, or MONETICO for the amount agreed on the reservation.
In the event of cancellation by the Client, all sums paid shall remain the property of Guadeloupe Shuttle
It is recalled that the prices of the services displayed on the website www.guadeloupe-shuttle.com are the result of the prices charged by Guadeloupe Shuttle for the services concerning it. For external service providers, Guadeloupe Shuttle does not in any way intervene in the determination of their rates. These prices are updated on the Site as and when the prices charged by Guadeloupe Shuttle and the partners change, it being specified that these changes will not be applicable to orders previously concluded. The prices of the services invoiced to the Client correspond to the prices in force on the day of the final confirmation of the order or reservation request by the Client on the website. The price of the services as shown in the summary of the booking request before any final confirmation by the Client corresponds to the total amount of the services due by the Client, including any extras selected. The price of the services is recalled in the order confirmation email sent by Guadeloupe Shuttle
Upon receipt of an invoice, Professional Customers may pay the amount corresponding to the Transfers executed on behalf of its representatives (employees, customers and suppliers) within 30 days only for regular Professional Customers. The Company issues a paper or electronic invoice, indicating the amounts to be paid by the Professional Client and the due date of payment.
The company sends the Customer by e-mail the detailed invoicing corresponding to the service, unless expressly requested for sending by post.
4/ TRANSPORT OF LUGGAGE AND ANIMALS
The baggage allowance is accepted in the size and weight of one suitcase of 25 kg per passenger, including a cumulative size of 158cm (length + width + depth) and one piece of hand luggage.
All additional luggage must be indicated at the time of your reservation with a supplement in force (5€) All special luggage such as bicycles, golf bags, canteens, trunks, kite surfing, bike crate, etc… must be indicated in advance at the time of your reservation with a supplement in force (15€).
The regulations concerning the transport of animals in the shuttle must comply with the following standards: Previously reported at the time of booking, installed in a transport cage provided for this purpose. In any case, the animal will not be able to leave its cage as long as it is inside the vehicle.
The transport of animals travelling in the cabin is free of charge. For animals travelling in the hold and in a cage a supplement is applied 15€
It is essential to indicate all the special features on the reservation so that the transfer complies with road regulations and passenger comfort.
In order to guarantee the safety of passengers, baggage must be deposited in the areas reserved for this purpose. They may not be carried on board the Vehicle in seats or traffic areas.
For safety reasons, it is prohibited to place the following products in luggage: compressed gas and in particular defensive bombs, aerosols, butane gas, explosive, flammable, corrosive, oxidizing, irritating or toxic products.
The baggage on board is the subject of all our care, but remains the sole responsibility of the traveller who must ensure, before each departure, that his suitcase is loaded.
The carrier shall not be liable for packages or hand luggage left in the vehicle, whether or not it is under the supervision of the driver or locked or unlocked.
We decline any responsibility in the event of loss, damage, theft of luggage, money, jewellery, glasses, souvenirs, mobile phones, cameras, cameras… left in the vehicles by Customers.
The Driver may refuse baggage that is excessive in weight or size, as well as baggage that he considers detrimental to transport safety.
Any object found in a Vehicle shall be deposited at the Company’s registered office, and the Customer may collect it within 3 months of the date of performance of the Service.
